Hiring Options: Exclusive Agreements

Initially, the thing which I find most companies hesitant about when it comes to working with a recruiter/agency are the fees. 

Many agencies will agree to discount their fees somewhat if the client is willing to sign an exclusivity agreement. 

Options to Consider:

  • Often used in conjunction with retaining an agency, an exclusivity clause can still be used with a contingency recruiting firm.
  • Your hires could still be permanent placement, contract, or contract-to-hire.
  • An exclusive agreement could be languaged for all positions, only one position, or only a group of positions (say, just "technical" jobs or "accounting/finance" positions).
  • If the recruiter/agency is still not locating the right talent for you, what are the terms of termination on the exclusivity agreement.
  • Some agreements expire on their own after a certain period of time.
  • Negotiate with your recruiter what happens if "the perfect candidate" walks in your door after you’ve signed.
  • Understand the penalties associated with hiring outside of the exclusivity clause.
